A Certificate of Compliance is required for all new build work and for any alteration, addition or extension work to an existing property to ensure that all works have been carried out in accordance with any planning permission granted and the Building Regulations.
Opinions of Compliance fulfill the same function as a Certificate of Compliance, however, are provided following completion of the building works. As part of our Pre-Purchase Surveys, we identify where Certificates of Compliance with the Building / Planning Regulations will be required to be produced by the Vendor of the property.
Typical alterations that require Certificates of Compliance with Building and Planning Regulations
Our Pre-Purchase Surveys/Home Inspections, carried out by Registered and Chartered Building Surveyors, provide a detailed report highlighting any defects or compliance issues that could be expensive to remedy post-sale.
Certification with Building Regulations is required for any works carried out after the 1st June 1992; however, transitional arrangements also apply. Building Bye-Laws (depending on whether such Bye-Laws were in force) apply prior to this in certain parts of the country.
Rear Extensions
Most rear extensions are planning exempt but the Exempted Development Regulations are very specific. A site inspection, therefore, is always required to confirm ‘Exempted Development’ status.
Structural Alterations
Structural alterations such as the removal of load-bearing walls or attic conversions must comply with Part (A) Structure of the Building Regulations.
Side Extensions
Planning Permission must be obtained for any extension works constructed forward of the rear building line.
External Alterations to Facades
As such works are considered an ‘improvement’ to a residential dwelling, planning is not required assuming the changes are relatively minor in nature. Any alterations substantially affecting the appearance of a property could very well required Planning Permission. If doubt exists a ‘Section 5’ Declaration should be obtained from the Local Authority.
